Is your charter flight delayed or cancelled? Claim your compensation

If the charter flight that took you or brought you from your vacation arrived at the destination more than 3 hours late or it was cancelled, you have the right to claim flight compensation.

 

According to the Flight Compensation Regulation 261/2004, your right to compensation does not change, whether you are travelling on a scheduled flight or on a charter.

All charter flights are covered by EC261/2004, therefore, according to the Air Passenger Rights provided for in this legislation, all passengers on charter flights are entitled to financial compensation for delays, cancellations or cases denied boarding.

 

Charter flight delayed or cancelled

When an airline sells all seats on a plane to a third party – usually a tour operator – the flight becomes a charter flight, reserved, for example, to transport travellers to a holiday destination.

If travellers get more competitive prices on a charter flight (where the offer even includes accommodation at hotels and destinations), on the other hand, they are more susceptible to flight disruptions, such as schedule changes, flight delays or even cancellations.

 

The right to flight compensation

Most travellers feel that they have no right to claim financial compensation for their delayed or cancelled flight because it is a chartered flight.

But this is a wrong idea and they end up losing up to €600 in compensation.

All charter flights are covered by EC261/2004, therefore, according to the Air Passenger Rights provided for in this legislation, all passengers on charter flights are entitled to financial compensation for delays, cancellations or cases denied boarding.

So relax: if your vacation has been affected by a flight disruption, know that you are entitled to claim financial compensation for your flight, provided your flight has departed from an EU airport or if your flight was operated by an airline registered in the EU.

Based on the distance travelled and the airline being found guilty of the 3 or more hours delay, the financial compensation provided for in EC 261/2004 is as follows:

€250 for flights up to 1,500 km;

€400 for flights between 1,500 km and 3,500 km;

€600 for flights longer than 3,500 km.

Charter flight delay compensation

Flight delay of 3 hours or more

If your charter flight was delayed by 3 hours or more and the delay was not due to extraordinary circumstances (such as bad weather, air traffic control, bird strikes, medical emergencies, security risks, political or civil unrest and other circumstances), you are eligible to claim financial compensation from the airline.

Let me just clarify the following: you are only eligible for financial compensation if the plane opened its doors upon arrival, more than 3 hours later than expected.

If you have been waiting for your flight departure for more than 3 hours but if the pilot compensated for this delay during the flight and you landed less than 3 hours late, your right to compensation no longer applies.

Based on the distance travelled and the airline being found  responsible for of the 3 or more hours delay, the financial compensation provided for in EC 261/2004 is as follows: €250 for flights up to 1,500 km; €400 for flights between 1,500 km and 3,500 km and €600 for flights longer than 3,500 km.

What if your charter flight is cancelled?

If the charter flight that was taking you or brought you from your vacation was cancelled, you may also be eligible to claim financial compensation, as long as you meet certain conditions, such as the time in advance that you were notified of the flight’s cancellation.

Let’s start with the bad news: if the airline has informed you about the cancellation of your flight up to 14 days before your departure, you are not entitled to claim any financial compensation. If this happens, the airline must offer you a transportation alternative or you can cancel your ticket and have a full refund.

Now the good news: if the airline informed you of the cancellation between 7 and 14 days before the flight departs, you can claim compensation for your cancelled flight if your alternate flight arrives more than 4 hours late.

If you were informed of the cancellation of your vacation flight less than a week before the flight and your alternative flight arrived more than 2 hours late you will also be eligible for financial compensation.

The other good news is that most flights are cancelled on the day they are scheduled. Therefore, in these cases, it is enough that your alternative flight reaches your destination at least 2 hours late for you to be eligible to claim financial compensation up to €600.
